DECREE 105/2025/ND-CP: WHAT SHOULD BUSINESSES PAY ATTENTION TO REGARDING THE MANAGEMENT OF FIRE FIGHTING EQUIPMENT?

On May 15, 2025, the Government issued Decree 105/2025/ND-CP detailing several articles and measures for implementing the Law on Fire Prevention, Firefighting, and Rescue. The Decree takes effect on July 1, 2025, replacing many previous regulations on fire prevention, firefighting, and rescue.

The Decree aims to improve the legal framework for fire prevention and firefighting, and enhance the responsibility of agencies, organizations, businesses, and individuals in ensuring fire safety.

This Decree details the measures for implementing the Law on Fire Prevention, Firefighting, and Rescue, including several important contents such as:

  • Regulations on fire prevention.
  • Regulations on firefighting and rescue.
  • Establishing and organizing firefighting forces.
  • Equipping and managing firefighting equipment.
  • Regulations and policies for those participating in firefighting.
  • Data management and responsibilities of relevant agencies.

Chapter V, in particular, focuses on regulations concerning fire prevention, firefighting, rescue, and emergency response equipment; the fire alarm database and communication system is considered one of the chapters that directly impacts businesses because it relates to the investment, equipping, management, and use of fire prevention and firefighting equipment.

1. Licensing for the circulation of fire fighting equipment (Article 23)

Target audience: those listed in Appendix V of this Decree.

2. Application for a Circulation Permit:

For domestically manufactured and assembled equipment:

  • Application for a circulation permit: Follow Form PC20 attached to this Decree.

  • Test results: Must demonstrate that the vehicle conforms to the declared applicable standards and corresponding technical regulations, as certified by a product quality testing organization in accordance with legal regulations.

  • Equipment factory certificate.

  • Equipment technical documentation (if any).

For imported equipment:

  • Application for a Circulation Permit: Follow Form PC20.

  • Equipment quality certificate.

  • Test results: Must conform to the prescribed standards and regulations. In the case of test results from a foreign organization, they must be certified by a testing organization conforming to ISO/IEC 17025 or an organization with accreditation as a testing organization.

  • Factory certificate.

  • Technical documentation of the equipment (if any)

Authority:

The Ministry of Public Security issues licenses for fire fighting, rescue, and relief equipment.

The Ministry of Construction issues licenses for fire-resistant and fire-retardant materials and components.

3. Procedures for applying for a permit to operate fire fighting, rescue, and emergency response equipment.
